Since 2002, Canada admitted to Canadian Permanent Resident Card issued immigrants, replacing the previous permanent residence permit. Moreover, the Permanent Resident Card must be updated every five years. There are permanent residents of Canada, “the residence” restrictions, the new Canada, “Immigration and Refugee Protection Act,” Article 28 provides: a permanent resident within any five-year period, must have two years of residence in Canada.
what to take into consideration when making a determination of residency status? By law, only the following three ways to satisfy this requirement:
- You physically live in Canada for at least 730 days in that five-year period;
- or you accompany your spouse who is a Canadian citizen living abroad;
- or you are outside Canada employed on a full-time basis by a Canadian business or in the public service of Canada or of a province
- or you are an accompanying spouse, common-law partner or child of a permanent resident who is outside Canada and is employed on a full-time basis by a Canadian business or in the public service of Canada or of a province.
